02.Infrastructure Architecture & Services Description

MeshMail operates an automated management and orchestration platform designed to streamline cold email setup. The Services encompass:

Domain & DNS Automation

Automated registration of secondary domains with accredited ICANN registrars and programmatic DNS record creation (SPF, DKIM 2048-bit, DMARC, custom tracking domains) via Cloudflare DNS APIs.

Mailbox Provisioning

Automated provisioning of authentic Google Workspace user mailboxes with 30 GB pooled Google Workspace storage per user and direct webmail access, or dedicated private SMTP fleet infrastructure.

Automated Warmup System

A peer-to-peer sending and receiving network that systematically ramps mailbox volume over 14 to 21 days with simulated conversational exchanges to build initial sender reputation.

Sequencer Connectivity

Seamless export and direct OAuth/API integrations with cold email sequencers, including Instantly.ai, Smartlead.ai, Lemlist, Apollo.io, and Reply.io.

03.Third-Party Services & Provider Disclaimers

MeshMail automates and integrates with independent third-party technology providers to execute its services:

Express Disclaimer of Affiliation: MeshMail is an independent software automation provider. MeshMail is not owned by, subsidiary to, endorsed by, or legally partnered with Google LLC, Cloudflare, Inc., Microsoft Corporation, or third-party outreach sequencer companies. All product names, logos, and brands are property of their respective trademark owners.

Your utilization of mailboxes, DNS, and domains is subject to the respective terms and acceptable use policies of upstream providers, including:

  • Google Workspace Terms of Service and Google Cloud Reseller policies.
  • Cloudflare, Inc. Self-Serve Subscription Agreement and DNS usage policies.
  • ICANN Registrant Rights and Responsibilities Agreement.

MeshMail is not liable for disruptions, global outages, policy revisions, account suspensions, or administrative interventions enacted independently by Google LLC, Cloudflare, Inc., or third-party outreach sequencers.

04.Domain Registration & 100% Client Legal Ownership

100% Client Domain Ownership Guarantee

Unlike black-box vendors who register domains under internal proxy shells, any domain registered via MeshMail is registered with accredited ICANN registrars in your company's legal name. You hold complete, unencumbered ownership of the domain asset.

  • Portability & Transfers: You may update nameservers, request domain authorization (EPP) transfer codes, or transfer your domains to any external registrar at any time directly through support or your account settings.
  • WHOIS Privacy: MeshMail enables standard WHOIS privacy protection on eligible domains by default to protect your organizational contact details from public web scraping.
  • Domain Fees: Domain registration fees ($9/year direct cost or as quoted at purchase) are paid immediately to the ICANN registry operator and are strictly non-refundable once registered.
  • Renewals: Domains renew automatically each year unless you toggle off auto-renew in your billing settings at least 14 days before expiration.

05.Acceptable Use Policy (AUP) & Anti-Spam Compliance

To safeguard our sending IP infrastructure, maintain high inbox deliverability for all clients, and uphold global communication standards, you must strictly comply with this Acceptable Use Policy:

A. Legal & Regulatory Compliance

All communications transmitted via mailboxes or infrastructure configured through MeshMail must strictly comply with applicable international email laws, including the United States CAN-SPAM Act, Canada's Anti-Spam Legislation (CASL), the European Union General Data Protection Regulation (GDPR), the UK Data Protection Act, and the Australian Spam Act 2003.

  • Every commercial message must contain a clear, conspicuous, and functioning one-click opt-out / unsubscribe mechanism.
  • All opt-out requests must be processed and honored within a maximum of 48 hours.
  • Headers, sender names, “From” addresses, and subject lines must be truthful, non-deceptive, and accurately identify your commercial entity.
  • Messages must clearly display a valid physical postal address or registered business address of the sender.

B. Mandatory Deliverability Benchmarks

Following the Google Workspace and Yahoo 2024 Bulk Sender Requirements, you agree to maintain clean email list hygiene:

Maximum Hard Bounce Ceiling
< 5.0%

You must verify and scrub all contact lists through verification APIs before initiating outbound sends.

Maximum Spam Complaint Rate
< 0.10%

Target complaint rate under 0.10%, with an absolute maximum ceiling of 0.30% per Google Postmaster standards.

C. Prohibited Content & Malicious Practices

The following activities are strictly prohibited and result in immediate account termination without refund:

  • Sending unsolicited messages to scraped, purchased, or unverified mass consumer lists (“blast spam”).
  • Phishing, credential harvesting, impersonation of financial institutions, or fraudulent spoofing.
  • Distribution of malware, ransomware, spyware, Trojans, or unauthorized tracking software.
  • Promotion of illegal contraband, illicit drugs, unregulated pharmaceuticals, adult/pornographic content, deceptive cryptocurrency schemes, high-interest payday loans, or multi-level marketing (MLM) schemes.
  • Hate speech, harassment, extortion, defamation, or threatening communications.

06.Fleet Deliverability Telemetry & Automated Circuit-Breakers

MeshMail deploys real-time deliverability telemetry to monitor DNS health, warmup ramp trajectory, bounce codes, and reputation signals across provisioned fleets.

Automated Circuit-Breaker Mechanism
If an uploaded prospect campaign triggers sudden bounce spikes exceeding 5% or triggers immediate spam blacklisting signals, MeshMail reserves the contractual right to automatically throttle sending frequency or temporarily pause sending queues. This circuit breaker protects your domain reputation, prevents permanent mailbox bans, and preserves overall IP fleet integrity.

When a circuit-breaker is triggered, our platform notifies your admin email with diagnostic logs and guidance on list verification remediation before resuming sending queues.

07.Deliverability & Performance Realities Disclaimers

MeshMail guarantees that it provisions genuine Google Workspace mailboxes, verified dedicated IPs, and correctly authenticated SPF, DKIM 2048-bit, DMARC, and custom tracking records on Cloudflare.

However, final inbox deliverability is an algorithmic outcome governed by recipient mail servers (e.g., Google, Microsoft, Yahoo) and is fundamentally dependent on factors outside of MeshMail's direct control, including:

  • The data accuracy and hygiene of your prospect lists.
  • The contextual relevance, tone, subject line, and spam-trigger words within your email copy.
  • Sending pacing, volume ramps, and recipient engagement (replies, deletions, marks as spam).
  • Changes made by Google LLC or Microsoft to their proprietary spam filter algorithms.

Accordingly, MeshMail does not warrant or guarantee that 100% of emails will reach recipient primary inboxes, nor does MeshMail guarantee specific open rates, click-through rates, reply rates, or sales revenues.

08.Billing, Subscriptions & Cancellations

All subscriptions, mailboxes, and domain registrations are billed in advance via credit card or authorized payment method processed through Stripe, Inc.

  • Recurring Billing: Mailbox seats ($2.50/seat/month for Google Workspace or tiered SMTP plans) renew automatically on each monthly anniversary date.
  • Scale On Demand: You can add or remove mailboxes at any time in your console. Scaled additions are billed prorated for the current billing cycle.
  • Cancel Anytime: You may cancel subscriptions at any time via Settings → Billing. Upon cancellation, your service remains fully operational through the end of the paid billing period.
  • Full Policy: All refunds and cancellation rights are governed exclusively by our dedicated Refund & Cancellation Policy.

09.Intellectual Property & Customer Data Ownership

Your Property: You retain complete, exclusive ownership of all proprietary data, prospect contact lists, email copy, brand marks, and outreach assets uploaded or transmitted through the Services. MeshMail does not claim any intellectual property rights over your customer data.

MeshMail Property: MeshMail retains all right, title, and interest in and to the MeshMail software, DNS orchestration engine, proprietary warmup peer-network algorithms, user interfaces, documentation, logos, and trademarks. You may not reverse-engineer, decompile, scrape, or resell the platform software without explicit written permission.

10.Limitation of Liability & Indemnification

DISCLAIMER OF INDIRECT DAMAGES:TO THE MAXIMUM EXTENT PERMITTED BY LAW, MESHMAIL AND ITS DIRECTORS, EMPLOYEES, PARTNERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUES, SALES OPPORTUNITIES, ANTICIPATED PROFITS, DATA LOSS, DOMAIN BLACKLISTING, OR THIRD-PARTY ACCOUNT SUSPENSIONS, REGARDLESS OF THE LEGAL THEORY ASSERTED.

Cap on Total Monetary Liability: In no event shall MeshMail's aggregate cumulative liability arising out of or related to these Terms exceed the total amount actually paid by you to MeshMail for the specific Services giving rise to the claim during the three (3) months preceding the event.

Customer Indemnification: You agree to defend, indemnify, and hold harmless MeshMail, its officers, employees, and affiliates from and against any third-party claims, liabilities, damages, fines, penalties, or expenses (including reasonable attorney fees) arising from your breach of the Acceptable Use Policy, anti-spam laws, infringement of third-party privacy rights, or unlawful email outreach.

11.Suspension & Termination

MeshMail may suspend or immediately terminate your access to the platform without prior notice if:

  • You violate our Acceptable Use Policy, engage in spam campaigns, or distribute malicious content.
  • You fail to satisfy payment obligations after formal billing notice.
  • Your outreach activities threaten the security, operational stability, or IP reputation of MeshMail or its upstream partner providers.
  • Required to do so by a competent court, regulatory body, or law enforcement agency.

Upon termination for cause due to spam or abuse, all provisioned mailboxes are deactivated, and all prepaid fees are forfeited. Customers whose accounts are terminated in good standing retain the ability to transfer any registered domains to an alternative registrar.

12.Governing Law, Dispute Resolution & Legal Contact

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute, controversy, or claim arising out of or relating to these Terms shall be resolved through confidential, binding arbitration in accordance with the commercial rules of the American Arbitration Association (AAA).
